Security and licensing

KuCoin is incorporated offshore, most recently re-domiciled to the Turks and Caicos Islands after previously being based in Seychelles, and does not hold a licence from a major financial regulator such as the FCA or ASIC. In January 2025 the exchange pled guilty in US federal court to operating an unlicensed money-transmitting business and failing to register with FinCEN, agreeing to pay over $297 million in fines and forfeiture and to exit the US market for at least two years; its founders separately agreed to step back from managing the company. The group has since pursued narrower regulatory footholds elsewhere: it reports securing an AUSTRAC Digital Currency Exchange registration in Australia in 2025 and a MiCA Crypto-Asset Service Provider licence in Austria in late 2025, after applying in early 2025.
